Safety — please read this one

Gannet is a planning aid. It is not a navigation system and it is not a safety device. Forecasts, tides, scores and suggested trips are estimates built from public data and modelling, and they can be wrong, out of date, or unavailable. Never rely on Gannet alone to decide whether it is safe to go out or to navigate by.

Always check dedicated marine forecasts and official safety sources before heading out, carry proper safety equipment, and use your own judgement. You are responsible for your own safety and for everyone aboard your vessel.

Spots shown in Gannet are a guide to the general area of a named feature, not an exact position — verify locations with your navigation equipment. Species listed for a spot are best guesses, not a promise. Suggested plans are suggestions, nothing more: conditions on the water can differ from any forecast, and going out, where you go, and whether to keep going are always your decisions. If it doesn't look right, don't go. To the extent the law allows, Gannet Pacific Limited accepts no responsibility for anything that happens on a trip, including a trip made following a suggested plan.

Fishing rules

Gannet shows bag limits, size limits, closures and protected areas to help you fish legally. We take that seriously and check it against Fisheries New Zealand, but rules change and mistakes are possible. The official Fisheries New Zealand rules are the authority, not this app. If Gannet and MPI disagree, MPI is right. You are responsible for fishing within the law.

Your account and your data

You are responsible for keeping your account details secure. Your fishing data is yours — we do not claim ownership of your logs, marks or photos. How we handle that data is set out in our privacy policy.

Subscriptions

Gannet offers paid subscriptions. These are purchased and managed through your Apple ID, and Apple's terms govern billing, renewal and refunds. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period, which you do in your Apple account settings rather than in Gannet. Some subscriptions include a free trial for eligible new subscribers, and its length is shown before you confirm; if you don't cancel before the trial ends, you'll be charged for the first period. Nothing in this section limits your rights under the Consumer Guarantees Act 1993.

Acceptable use

Please do not attempt to break, overload or reverse-engineer the service, scrape it in bulk, or use it to do anything unlawful.

Availability

We do not promise the app or its data sources will always be available. Weather, chart and ocean data come from third parties and can go down or change without notice.

Liability

To the extent the law allows, Gannet Pacific Limited is not liable for loss or damage arising from your use of Gannet, including decisions made using its forecasts, scores or rules information. Nothing in these terms limits your rights under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those apply to you.

Changes

We may update these terms. If we do, we will change the date at the top of this page.

Governing law

These terms are governed by New Zealand law.
